Guardianships
If a person you are caring for is no longer able to care for themselves or manage their affairs, then you need to make an application to the court to become their Guardian. Guardianships can be Temporary or Permanent. They can be limited to a few areas of decision making or all areas. You may seek to be appointed as Guardian for just the property, just the person, or both.
Making the determination to seek guardianship of a parent, can be a difficult and emotional transition for a child. Parents have a hard time coping with loss of independence and often refuse to accept help. How many of us have had our aging parents tell us, "Everything is fine, dear, thank you so much" or "I just want to be left alone" or "I'll take of that tomorrow."
Before turning to the Guardianship option, we will explore the possibility of having the person sign a Power of Attorney document. After completing a basic capacity examination, the person may have the capacity to complete a Power of Attorney document that you can use with financial institutions and health care facilities to act on behalf of the person.
